Yuvinali Minani and his wife Habiba Nakazi have been convicted to 26years in prison for murdering Fred Kalyango.
The duo who committed the offense on 2, August, 2013 at Naguru village in Namayumba Sub County, Wakiso, were convicted by trial Judge Dr. Justice Joseph Murangira after court found them guilty of committing the murder case.
Justice Murangira told court that though the two assessors in their joint opinion advised court to acquit the convicts, it’s the duty of the trial Judge to evaluate prosecution evidence as a whole. The Judge noted that basing on prosecution evidence, the convicts killed the deceased whom they beat up demanding where he hid their Shs 10,000 and consequently the deceased died of injuries sustained due to severe beatings.
In his wisdom Justice Murangira ruled that he concurs with the Prosecution Lawyer that commission of the offense was premeditated since the convicts were not under the influence of any drugs and that there is need to send a clear message to the public to desist from mob justice. He added that he also agrees with Prosecution that the convicts are adult enough and would set a clear example as opposed to the youths who in this case would be excusable before handing the convicts a 26year jail sentence.
