High Court Judge Isaac Muwata has dismissed the bail application which was filed by one Herbert Arinaitwe, who was accused of leaking nude photos of socialite and media personality Martha Kagimba aka Martha Kay.
Arinaitwe is charged with cyber stalking, aggravated robbery and demanding property with menaces and intent to steal from the one Kagimba.
He recently applied to court seeking to be released on bail pending the hearing of his case.
Among the grounds for his bail he said, he had substantial sureties, that he was ready to turn up in court whenever he is required to and that he has a fixed place of abode within Court’s jurisdiction.
The trial judge however, declined the application noting that the applicant didn’t prove any exceptional circumstances which could convince court to release him on Bail.
“It’s the constitutional right for every innocent individual to apply for the bail but to grant it, it’s the discretional of the trial judge.” Judge Muwata ruled.
However, the judge issued orders to have the matter fixed for expeditious hearing in respect of the applicant’s constitutional right to a fair and speedy trial.
Last week the Director of Public Prosecutions (DPP) opposed to Arinaitwe’s bail application on grounds that the accused didn’t produce sufficient evidence to prove that he has a fixed place of abode in Bisheshe Village, Lugusulu sub county, Sembabule district.
Prosecution led by Timothy Amerit contends that on 11th April 2019 in Kampala, Arinaitwe robbed Martha Kay’s Samsung Galaxy Mobile phone and an I phone both valued six million shillings.
It was further alleged that before the said robbery, the accused person used drugs on Martha Kay which left her in unconscious condition.
