The Entebbe Chief Magistrates Court is set to decide on whether or not to cancel the bail which was granted to Pastor Aloysius Bujjingo.
Bujjingo and his partner Susan Makula were last week released on a Shs 3million cash bail each by the Entebbe Grade 1 Magistrates Court.
These are being accused by Lawyer Male Mabirizi of contracting a marriage under Customary Law yet Mr Bujjingo is already married under the Marriage Act to Teddy Naluswa
However, Mr Mabirizi today filed an application before the Chief Magistrates Court seeking to overturn the Grade One Magistrates bail.
Mabirizi claims among others that the lower court mishandled the entire process leading up to the bail.
He notes for instance that the lower court should not have on 21st January 2022, granted the Director of Public Prosecutions (DPP) audience, when he (Mabirizi) had earlier on January 12th filed a petition challenging the DDP’s U-Turn decision to take over the case.
The lawyer also alleges that he was denied audience by the lower court in respect of his affidavit in objection of granting the bail, leading to Grant of bail on strength of a “No Objection” by the DPP.
In an earlier affidavit challenging Bijjingo’s bail, Mabirizi claimed that the pastor had threatened his life. These decisions by the court, Mabirizi said were “incorrect, illegal, improper and irregular.”
“I pray that you cancel bail granted to pastor Aloysius Bujjingo, remand him to prison and his new bail Application, if any, be heard after you have heard and determined my Criminal Application No.03 of 2022 to strike out DPP’s 12 Jan 2022 U-Turn letter 4.” He wrote.
