Government is set to challenge the recent court order for the release of Ugandan writer and Kakwenza Rukira Bashaja, who was recently arrested by security operatives on allegations of insulting President Yoweri Museveni and his son Muhoozi Kainerugaba

Makindye Grade One Magistrate Irene Nambatya earlier this week ordered for the unconditional release Kakwenza, who was arrested by plain clothed security operatives from his home in Kisasi, on 28th December 2021.

This ruling was delivered in presence of Kakwenza’s lawyers Eron Kiiza and Luyimbaazi Nalukoola, but Government lawyers were absent.

Kakwenza however, was never revealed from detention, causing concern from some members of the public and human rights activists.

Yesterday, the Government finally made known their intention to challenge the court’s ruling.

The Solicitor General’s office wrote to the Makindye Magistrates Court seeking a copy of the Tuesday ruling, in order to “take appropriate action.”

“The Respondent, being dissatisfied with the orders of the trial Magistrate, therefore, requests that you urgently avail the Attorney General with a certified copy of proceeding, ruling and Order to enable us take appropriate action,” wrote Christine Kaahwa on behalf of the Solicitor General.

Mr Kakwenza’s lawyers said their client had been tortured while in detention and needed urgent medical attention.

These claims however, were dismissed as false by Charlese Twiine the spokesman of the Police’s Criminal Investigations Division.
