City Lawyer Hassan Male Mabirizi has sued Pastor Aloysius Bujjingo of House of Prayer Ministry for allegedly contracting marriage under customary Law when already married under the marriage Act.
Mabirizi has also sued Susan Makula Nantaba who introduced Pastor Bugingo to her parents on Tuesday , accusing her of engaging in Marriage with someone previously married.
In his private prosecution case filed at Entebbe Chief Magistrate Court, Mabirizi claims that Aloysius Bujjingo, on the 7th of December 2021, at Kawuku,Katabi Town Council, Wakiso district, while having contracted marriage under the marriage Act with Teddy Naluswa Bujjingo and during the continuance of that marriage, contracted a marriage in accordance with customary law with Susan Namakula Nantaba.
Mabirizi further accuses Susan Makula who is unmarried of going through the Marriage ceremony with Bujjingo, a person she knew was married to Teddy Naluswa.
He claims that both Pastor Bujjingo and Susan Makula went through the said Marriage ceremony while knowing that Pastor Bujjingo was legally married to his first wife.
According to Mabirizi, both Makula and Pastor Bujjingo are criminally liable and that the Uganda Police that was aware of the said unconstitutional activities chose to escort and guard them and their illegal function instead of arresting the two.
He wants court to summon the two over the alleged Criminal offences and consequently nullify their customary marriage.
Mabirizi claims that on the 20th of December 2003, Bujjingo married Teddy ,through a church marriage at Victory Christian Center Ndeeba, after which marriage was solemnized and it still subsists.
“Any person who being unmarried,goes through the ceremony of marriage with a person whom she or he knows to be married to another person, commits an offence and is liable on conviction to imprisonment for a period not exceeding five Years.” said Mabirizi.
Pastor Aloysius Bujjingo fell out with the mother of his three children and filed for divorce, but , pastor Teddy Bujjingo vowed to never divorce her husband as away of honoring the marriage vowels that she took back in 2003 of “until Death do us Part”.
