The High court in Entebbe presided over by Entebbe Resident Judge, Justice Flavia Nabakooza has today May 22, 2025 sentenced a 44 year- old man to 8 years in jail over aggravated defilement.
However, the Judge deducted the 5 years and 11 months the convict had spent on remand revealing that the convict would now serve 2 years and 1 month plus 7days in jail.
The convict identified as Emmanuel Wandera, a resident of Nkumba Central cell in Katabi Town Council, Wakiso district, was sentenced upon entering a plea bargaining agreement which was read to him before the presiding Judge whom he assured that he agrees with the content in the plea bargaining agreement adding that he was not forced to sign it and above all, he was very sobr.
In her ruling, Justice Flavia Nabakooza informed court that her court was lenient with the convict because he has not wasted Court’s time and resources.
Prosecution states that between April 2019 at Nkumba Central cell in Katabi Town Council, Wakiso, Emmanuel Wandera aged 44, performed a sexual act with Jazira Assimwe aged 17 and shattered her tiny private parts on top of exposing her to HIV/AIDs.
Prosecution also revealed to court that the convict was sharing the same bedroom with the victim though sleeping on different beds. However, after staying with the victim for some 4 days, the convict informed the victim that she was no longer his maid but instead his wife. He promised her heaven on earth and pledged to take up all her basic needs.
Having convinced the victim, she surrendered her tiny thing to him and he consequently shattered her with his huge thing. The victim endured his huge penis for 4 days until she later felt uncomfortable in her private parts. This prompted her to inform the nearby neighbors about the matter who in turn reported it to Entebbe police station. Police swung into action and apprehended the convict.
The victim was examined at Entebbe police, and she was found to be 17 years based on her birth certificate. While the convict was examined by Dr. John Kalyesubula on police form 24 and he was found to be 44years and HIV positive.
Prior to sentencing the convict, Prosecution Lawyer told court that it’s so absurd that the convict exposed the victim to HIV/AIDs yet he knew very well he was HIV positive adding that offences of such nature are so rampant in the community and that there is need to keep away the perpetrators for some time to enable them reform.
