
The family of former Uganda Airlines flying Captain Darlington Omamteker is on bended knees after losing round two of the land squabble against their neighbor in Entebbe.
This follows after the family of Capt Darlington Omamteker dragging one Peace Barigye and her agents to courts of law over trespassing on their land along the Uringi Crescent in Entebbe, Busiro County in Wakiso district
The two neighbors have been fighting like lions for a small piece of land along the Uringi crescent road between plot 31A & plot 31B for the last couple of years.
Mrs Omamteker is pinning her neighbor Peace Barigye on encroaching on about 1.5 meters of their family land.
It’s now official that Capt Omamteker family is milking a dead cow after losing the court battles & torture cases against one Peace Barigye over the contested land in Entebbe sub division.
Rosemary Kiiza Omamteker accused her neighbor of trespassing on her property and blocking her access to their land, reads report.
Justice Bernard Namanya has ruled out that Capt Omamteker family pay for legal damages and costs after losing the land battle in the Kampala land division court, reads 7paged document.
Through her lawyers, Omongole and Company Advocates, Omamteker sued Barigye in the Civil Division of the High Court in Kampala.
Justice Namanya heard the application with only applicants Mr and Ms Omamteker together with their daughter over the contested land along the Uringi crescent road in Entebbe municipality.
Court further heard that Mrs Omamteker contracted surveyors over the geometrics of plot 31A in the said area and advised the matter to be handled privately by the two parties but this all went futile.
According to reports, when the case resumed on February 8, 2023, the state attorney, Janet Annet Nabulobi, informed the court that she did not have the police file of accused Yunus Magom.
She further stated that the case file had been recalled by the Regional Office of the Director of Public Prosecutions at Nakawa.
This prompted the presiding magistrate, Naume Sikhoya, to adjourn the case to March 6, 2023, for mention. So far, only one witness has testified in the matter. Magom is facing a charge of criminal trespass, which he has since denied.
Omamteker also revealed that she had requested the office of the town clerk, Entebbe Municipal Council, to take action against Barigye and to protect the boundaries of the land.
Mrs Omamteker further told court that she asked Ms Barigye to pay for the piece of the land she had encroached on but she refused and instead went ahead to construct in the access road.
“We share the access road to our respective plots of land but with arrogance, Mrs Barigye blocked us from accessing our plot by constructing & putting up a gate”, reveals report by Mrs Omamteker.
Meanwhile three(3) other witnesses will be giving testimonies against one Magomu Yunus and other in a case before the Entebbe chief magistrate court, reads DPP file no.1530/22
Mrs Rosemary Kiiza Omamteker also the proprietor of Entebbe Junior School sued Entebbe Police Officer in Charge (OC), Kassim Mambo, for plot her arrest and yet she escaped from police by whiskers.(Watch The Space)
