Three City Business Men including the Director of Kisha Investments Ltd, Mark Kakooza have been acquitted after pocketing over two billion shillings from Dr. Livingstone Ddungu, the Director of Naalya secondary schools in a botched deal. The tycoons were acquitted by Kampala High Court Assistant Registrar Lawrence Tweyanze who reasoned that prosecution failed to produce sufficient evidence to implicate the crafty fellas in a dirty deal. This follows after the former Entebbe Chief Magistrate Joyce Kavuma then a presiding magistrate rejected all the evidence Naalya S.S tycoon Dr. Livingstone Ddungu produced against fellow tycoon Mark Kakooza. She rejected a memorandum of understanding which Dr. Ddungu’s brother in-law Nicholas Kaweesa presented to court to down pin Mark Kakooza and three others
co-accused in an alleged fraud game. Nicholas Kaweesi, a lecturer in Information Technology (IT) in South Sudan had alleged that tycoon Kakooza’s co-accused admitted having been part of the ploy to con him and Ddungu of Shs2.6bn and when Yasin was arrested he signed a memorandum of understanding returning the vehicles he had received as part of his share in the dirty deal. The other documents which were rejected included receipts allegedly signed by Mark Kakooza acknowledging receipt of different sums of money. These were dated March 4, 2013 for Shs139m, March 11, 2013 for Shs36m, April 30, 2013 for Shs379.5m, and May 8, 2013 for Shs253m among others. These were rejected after Kakooza’s lawyer Ambrose Tebyasa told court that signatures attributed to Kakooza were subjected to forensic examination by police and they were discovered not being his. The other documents rejected included a search report dated May 18, 2013 done by Sale Mark Booth of UN Airbase in Entebbe. The lawyers reasoned that there was nothing that shows that Kaweesa had received these documents. Mark Kakooza has been accused together with Yasin Kakooza, Michael Kitandwe and Nelson Nabende of impersonation, uttering false documents and conspiracy to defraud Dr.Ddungu and his in-law Kaweesa. Ddungu claimed the four purported to be UN officials and in turn opened up a civil suit at the High Court and police accused him of hatching a plot to frame and blackmail them with these charges. They claimed Ddungu and Kaweesa were dealing in Black Dollars in South Sudan and when they lost all their monies in those shoddy deals they came back and framed tycoon Kakooza and his colleagues in order to get money from them to stock up their businesses in South Sudan. Meanwhile, prosecution alleged that between March and June 2013 while at Entebbe in Wakiso district, Mark Kakooza, Michael Kitandwe, Yasin Kakooza and Nelson Nabende teacher at Agoko senior secondary school in Abei area, all residents of Mutesasira zone in Kikaya/Bulenga along Mityana road allegedly conned Shs 2.6b from tycoon Dr. Livingstone Ddungu and Nicholas Kaweesa in a shoddy deal (By PEACOCK KAWEESA)
